1. General
1.1
These terms apply to any use of Delvo’s services, including through the website platform and mobile applications.
1.2
The DELVO application, downloadable via any computer or other communication device (the “Application”), is owned by Delvo Technologies Ltd. (the “Company”).
1.3
The Application connects businesses (including restaurants, shops, or any other corporate or commercial entity that has entered into an engagement agreement with the Company and opened an account in the Application) operating in various fields and requiring delivery services for their business (the “User” and/or the “Users”), with couriers who are independent contractors interested in receiving offers to perform deliveries (the “Courier” and/or the “Couriers” and/or the “Delivery Services”), and enables Users and Couriers to make use of the Company’s technological services.
1.4
The Company respects the privacy of Users and Couriers accessing the Application and treats information protection with due seriousness.
1.5
The purpose of this Privacy Policy, which constitutes an integral part of the Terms of Use, is to review, among other things, the manner in which the Company handles personal information collected in the course of your use of the Application and/or the technological services provided by the Company, whether via the Application, telephone support services, and/or any other auxiliary service, as applicable from time to time (the “Services”).
1.6
Please read this Privacy Policy carefully and ensure that it is understood by you and that you agree to its terms. It is hereby clarified that most of the information you provide and/or that is collected about you is not required by law, but is provided solely at your discretion and with your consent, inter alia, in order for the Company to be able to provide you with certain services. Without such consent, you will not be able to use the Application or access the Services. Blocking cookies may impair the proper functioning of the Application and the personalized user experience.

If you do not agree with the provisions of this Privacy Policy or object to the Company collecting, processing, transferring, and using information relating to you, please refrain from registering for or using the Application. You are entitled to exercise your rights with respect to your information (as detailed in Section 9 below) at any time.

The Company may update this Privacy Policy from time to time to reflect technological, business, legal, or regulatory changes. Any such update will be reflected in this document. Continued use of the Application following such changes shall constitute your consent thereto.

2. Privacy Policy Summary
2.1 What is the Privacy Policy and why is it used?
This document describes how we collect information and how we use it.
2.2 What data do we collect?
The Application connects Users in various fields who require delivery services for their business with Couriers who are independent contractors interested in receiving offers to perform deliveries. For this purpose, we collect and process information required by us, including, for example, personal information you provide upon registration to the Application (such as name, phone number, address, email address, and payment method details), business-related information such as business or company name, commercial terms, contact details with Couriers and recipients (the business’s customers), their identities, details regarding the delivery itself (delivery details, recipient details, travel route, delivery address, delivery status, etc.), GPS-based location of Couriers’ mobile devices where they have chosen to share such information, and any other information the Courier chooses to share.
In addition, we collect information regarding your use of our Services (such as technical usage data, login and logout times, IP address and connectivity data, device and application data including type, operating system, application ID, advertising ID, application and browser versions, location, time zone and language settings), documentation and analysis of interactions with the Application and related notifications, cookies and pixels installed or used, information stored in our systems, direct inquiries and communications with us including via chat, and additional information received from third parties.
2.3
Details of an end customer (a private customer) who placed a delivery order via the Application are retained. When a Courier performs the delivery, an SMS message is sent containing a link to a web page where the Courier’s location, estimated time of arrival, and chat communication with the Courier and the restaurant can be viewed.
2.4
Courier consent to processing of personal data including location services as a condition for using the Application and engaging with Users to perform independent deliveries, you are required to provide your consent to access location services via your mobile device settings and permissions. You may remove the Application from your mobile device or revoke permission to access location services; however, in such case it will not be possible to continue providing services to DELVO and/or continue using the Application.
2.5
In order to provide the Company’s Services, information regarding the Courier’s location is collected (monitored) and shared with the restaurant, business, and end customer so that they may track schedules and delivery times. In addition, location and monitoring services enable end customers to locate the nearest available Courier. Monitoring of the Courier’s location is performed approximately every 30 seconds. This location information is stored in the Company’s systems and shared with service requesters and recipients.
2.6
The information and location data are retained for future monitoring and review of the Courier’s location during a specific delivery that occurred in the past.
2.7 Purposes of Use of Information
We collect and use information solely to the extent necessary to provide the Services through the Application and for certain processing purposes. Among other things, we use the information for the following purposes:
- Providing the Services and use of the Application in order to connect Couriers for the performance of deliveries;
- Fulfilling our obligations under the engagement agreement between us;
- Verifying your identity for the purpose of granting access to the Services;
- Contacting you at your request and/or via general or personal messages relating to the use of the Services and/or via marketing messages;
- Statistical, analytical, and research purposes, including customization, development, data enhancement, and improvement of the Services, and for ongoing management and control purposes;
- Evaluation, testing, and monitoring of the Services for the purpose of identifying and resolving malfunctions and bugs and improving and developing new technologies and features within the Services;
- Sharing information relating to Users, deliveries, order fulfillment for end customers, and sharing information relating to Couriers (such as name, contact details, license and vehicle details, location) with Users, Couriers, and customers as required for the provision of the Services or as required by law and/or an order of a competent authority for handling inquiries and complaints;
- Updating you regarding changes to the engagement terms, Privacy Policy, or any other change relevant to our engagement and the provision of the Services through the Application, including support services and/or complaint handling;
- Processing information in order to comply with the Company’s legal obligations;
- Information security and protection of the Company’s operations and the rights and interests of the Company and/or its employees and/or service providers and/or customers and/or Users and/or Couriers and/or any other person or entity, including for the prevention or reduction of fraud, deception, or any other illegal or prohibited activity.
2.8 What choices do you have?
We allow you to determine your preferences regarding the use of information about you. For example, you may at any time request to stop receiving marketing messages, delete or block cookies, update your personal details, request deletion of information, and more.
With whom do we share information?
We share information within the Company and, at times, with partners and others in order to fulfill the purposes of use of information about you in accordance with this policy, including service providers, external companies, and third parties that provide us with complementary services supporting our operations. Their use of information will be limited solely to the specific purpose for which they were engaged.
Information is also shared between Users and Couriers in order to fulfill the purpose of the platform to mediate between businesses requiring delivery services and independent Couriers willing to perform them. This information may include, inter alia, User and Courier details, recipient details, contact information, delivery details, Courier availability status, and GPS-based location of the Courier’s mobile device where the Courier has chosen to share such information.
How do we use statistical and non-identifiable information?
We use statistical data and other non-identifiable information for business purposes, such as creating statistical reports for internal use.
Where is the information stored?
The information we collect is stored in our information databases. We may store and process information at various locations, including cloud-based systems.
How long is the information retained?
We retain information as required in order to provide our Services, for management purposes, and in accordance with the law.
We may retain information relating to you for as long as it is reasonably required for the purpose or purposes for which such information was collected or created by us, and no longer than required, all in accordance with our data retention policy and subject to applicable legal requirements. Unless otherwise required by law or a binding agreement, we are not obligated to retain information relating to you for any fixed period and may securely delete it at any time and for any reason.

We secure and protect information about you in accordance with the strictest industry standards.
What about third-party privacy practices?
This Privacy Policy applies solely to the Company’s Services.

This Privacy Policy constitutes an integral part of the Terms of Use.
3. Registration on the Website and Provision of Information to the Company
3.1
Registration to the Application requires the provision of personal information such as your name, contact details, and email address. Without providing the requested information, you will not be able to use the Services (the “Registration”).
3.2
It is hereby clarified that you are under no legal obligation to provide such information, and that providing the information depends solely on your will and consent.
3.3
The User hereby declares and undertakes that all information provided and/or updated by him is true, reliable, and accurate, and that the registration and/or provision of information was performed in his own name and for himself only, and not on behalf of third parties, except where expressly authorized to do so.
3.4
The information you provide, as well as additional information accumulated about you and your actions, will be stored in the Company’s database and used in accordance with the purposes of the database described above and this Privacy Policy and/or as required by law.
4. Collection and Use of Information
4.1
We collect and use information solely to the extent necessary to provide the Services through the Application and for certain processing purposes, including the purposes detailed above.
4.2
In addition, the Company may collect and use information provided by you at the time of Registration and/or information accumulated about you during your use of the Application in order to improve, enhance, or modify the Application, the Services, and the content offered therein, and in order to update you regarding services offered by the Company, on its behalf, and/or by third parties with whom the Company has business collaborations. The Company may also use information for marketing and statistical purposes and provide statistical information to third parties, including advertisers, subject to this Privacy Policy. Such statistical information will not personally identify you.
4.3
Subject to the provision of your contact details and your consent to receive direct marketing communications:
a. Operational Messages – The Company may send you, from time to time, information regarding its Services via email and/or other communication methods you have provided. You may control some of these messages through the notification settings available in the Application or your mobile device settings. Certain messages may be essential for the operation and provision of the Services (such as password reset or payment notifications) and cannot be opted out of.
b. Marketing and Promotional Messages – The Company may send you marketing or promotional messages. Such messages are sent via a system provided to the Company by an external service provider. Accordingly, you acknowledge that the Company shall not be liable for claims under spam laws or for malfunctions beyond its control. You may withdraw your consent at any time by contacting office@delvo.co.il or following the instructions included in such messages.
5. Cookies and Data Analytics Tools
5.1
The Application uses certain monitoring technologies such as cookies, pixels, and tags for its regular and proper operation, including collecting statistical data regarding usage of the Application and Services for statistical, research, and commercial purposes, as well as for information security, maintenance, and improvement of the Application, marketing activities, and user experience.
5.2
Cookies are small text files stored on your computer or mobile device via your browser. Cookies enable us to collect various data, such as duration of visits, pages visited, referral sources, browsing habits, ISP details, IP address, and general device location. Cookie data is encrypted, and the Company takes precautions to ensure that only the Company’s computers or those acting on its behalf can access and understand such data.
5.3
Upon your first visit to the Application, you may receive a notice regarding the use of cookies, allowing you to accept, customize, or reject cookies (except for essential cookies that cannot be disabled). You may manage your cookie preferences at any time via your browser or device settings. Please note that disabling cookies may result in certain features or services being unavailable.
5.4
We also use Google Analytics, a web analytics service provided by Google Inc. Google Analytics uses cookies to analyze usage of the site. Information generated by cookies regarding your use of the site may be transferred to and stored by Google on its servers.
5.5
Google uses this information, among other things, to evaluate usage of the site, generate reports on site activity, and provide other services related to internet usage. Google may transfer such information to third parties where required by law or where such third parties process the information on Google’s behalf. Google will not associate your IP address with other data held by Google.

5.6
The site uses remarketing with Google Analytics for online advertising, enabling ads to be displayed on third-party websites or Google based on prior visits. Cookies are used for this purpose to tailor advertisements.
5.7
We do not combine data collected through Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics is restricted by Google Analytics’ Terms of Use and Google’s Privacy Policy.
5.8
You may prevent cookie storage via your browser settings; however, this may limit functionality. You may also opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on available at: tools.google.com/dlpage/gaoptout, and manage ad preferences at: www.google.com/settings/ads
5.9
By using the site, you consent to data processing by Google as described above.
6. Disclosure of Information to Third Parties
The Company will take reasonable measures to prevent disclosure of personally identifiable information to third parties, except in the following cases:
- At your request and/or with your explicit consent;
- Where required for provision of the Services;
- Within business collaborations with affiliated companies;
- In cases of violation of the Terms of Use, this Privacy Policy, or applicable law;
- Pursuant to a judicial order;
- In connection with disputes, claims, demands, or legal proceedings;
- Where disclosure is necessary to prevent serious harm to property or persons, at the Company’s sole discretion;
- In the event of transfer or assignment of the Company’s business or rights and obligations, provided the receiving party assumes the obligations of this Privacy Policy.
- Nothing herein shall derogate from the Company’s right to disclose non-personal, non-identifiable information.
7. Information Security
7.1
The Company uses reasonable physical, technological, and organizational security measures in accordance with industry standards and applicable law to protect the confidentiality of data provided by you.
7.2
The Company clarifies that in cases beyond its control or resulting from force majeure, it does not guarantee uninterrupted operation of the Application or absolute protection from unauthorized access and shall not be liable for any direct or indirect damage resulting therefrom, including infringement of privacy.
7.3
All credit card processing is performed securely via an external payment service provider using advanced encryption methods in accordance with international standards.
8. Credit Card Information
8.1
The Application includes payment tools. All payments are processed via a certified payment service provider compliant with the PCI DSS (Payment Card Industry Data Security Standard). In the event of suspected misuse of a credit card, users should contact their credit card company and act in accordance with its instructions.
9. Your Rights Regarding Information and How to Exercise Them
9.1
Pursuant to the Israeli Protection of Privacy Law, 1981, you are entitled to the following rights:
- Right of access – to request access to personal information held about you;
- Right to correct or delete – to request correction, updating, or deletion of personal information;
- Right to withdraw consent – where processing is based on consent, you may withdraw such consent at any time.

10. Miscellaneous and Contact Information
10.1
This Privacy Policy may be updated from time to time by publication of a revised version. Generally, the updated version will apply from the date of publication. If we believe that an update includes material changes, we will provide advance notice via the Services or other appropriate means. Upon expiration of the notice period, the updates shall be deemed accepted by you.
10.2
The Services may include links to third-party websites. The Company is not responsible for the privacy practices of such third parties. External websites and services are subject to their own privacy policies and terms of use.
